UNDERSTAND YOUR OPTIONS

Advice for your circumstances.

The Administrative Review Tribunal (ART) conducts independent merits review of certain migration decisions. These may include some visa refusals or cancellations and some nomination or sponsorship decisions. Not every decision can be reviewed, and the person entitled to apply must be identified.

We review the decision letter and reasons, help assess the available review pathway, and organise the evidence relevant to the issues. Where engaged, we can assist with submissions, Tribunal directions and hearing preparation.

THE PATHWAYS

From decision to review.

01

Review rights & deadlines

Start with the exact decision notice. Eligibility, who may apply and the deadline depend on the type of decision and its circumstances.

02

Evidence & submissions

Understand the reasons for the decision, identify the issues and organise relevant evidence for the review.

03

Directions & hearings

Respond to Tribunal directions and prepare for a hearing where required, within the agreed scope of representation.

HOW WE HELP

A thoughtful plan. Clear next steps.

  • Assess the decision and possible review eligibility.
  • Identify the decision-specific deadline.
  • Organise evidence and prepare agreed submissions.
  • Help you prepare for Tribunal directions and hearings where engaged.

BEFORE WE TALK

Prepare for your consultation.

You do not need every document ready to make an enquiry. For a detailed consultation, the following can help us understand your position.

  • The complete decision letter and information about when and how you received it.
  • Your original application, supporting evidence and Home Affairs correspondence.
  • Current visa details and any existing Tribunal application or directions.
  • Evidence relevant to the refusal or cancellation reasons and any changed circumstances.
Bring documents to your consultation when requested. Please leave passport numbers and sensitive documents out of the initial enquiry form.

COMMON QUESTIONS

A little more clarity.

Can every visa refusal be reviewed?

No. Review rights depend on the decision and the applicable law. We must also check who is entitled to apply.

How long do I have to apply?

Use the exact deadline applicable to your decision. Many migration review deadlines cannot be extended; different rules can apply to other decision categories. Seek advice promptly rather than waiting for an enquiry response.

Does a review guarantee a visa?

No. The ART makes its own decision based on the facts, evidence and law. Possible outcomes can include affirming, varying, setting aside or remitting a decision; a review does not guarantee a visa grant.
